[Further update on the Shakedowners] Image: Ed Fagan with mother of a Soweto apartheid victim he was helping, Hector Peterson Fagan goes to ground as malpractice suits pile up By Terry Bell Cape Town – Ed Fagan , the controversial American personal injury lawyer who has lodged claims for billions of dollars against British and US firms for profiting from apartheid, has had judgments of more than $3 million (R19.6 million) for malpractice awarded against him by US courts.
But the man who announced in June that he was also suing the South African government for billion cannot be found. New York lawyer Mark Schwartz is now trying to locate Fagan to enforce a .2 million judgment awarded by the Manhattan supreme court. New York lawyer Hal Lieberman , who was appointed by Fagan to represent him, has said he no longer represented Fagan. A New Jersey attorney confirmed he was seeking Fagan to demand 0 000 for malpractice.
Fagan has lost another $167 000 malpractice suit and paid costs in Austria, where he was sued for incompetence. The $3.2 million judgment and several pending cases relate to grievances by former clients whose lawsuits were dropped or mishandled when Fagan took on the case against Swiss banks, which had misappropriated funds of Holocaust victims. The case gained him international fame, notoriety and an estimated pay cheque in excess of $5 million.
Although castigated by other lawyers who worked on the Holocaust cases, he became the public face of the most publicised human rights lawsuit ever.
But former clients, some of whom had strong personal injury cases dismissed when Fagan failed to appear or bungled the legal paperwork, took their grievances to court. “It looks as if the abominable showman has finally had his day,” said former Truth and Reconciliation Commission investigations chief Dumisa Ntsebeza , who is the leader of the legal team that took the first apartheid claims case before the courts in New York.
Ntsebeza and the US and other South African lawyers in the team fired Fagan when the apartheid claims cases came to court last November [2003]. They cited Fagan’s erratic behaviour and headline-grabbing antics as the reasons. Fagan responded by issuing a subpoena against Ntsebeza. When the matter came to court, however, the judge ruled Fagan’s subpoena was grossly defective and Fagan, who failed to appear, should be held liable for costs.
Fagan ignored the proceedings and appeared in Austria, where he garnered more headlines by saying he would sue the German government for $18 billion for art works allegedly stolen during World War 2.
He turned up in Johannesburg to loudly announce he could not be fired from the apartheid case, adding that he had instituted another case, with former president Nelson Mandela and President Thabo Mbeki as respondents. “Every time he opened his mouth, he got publicity,” said John Ngcebetsha , an attorney whose firm co-ordinated the original claims launched by the Apartheid Claims Taskforce in 2002.
