victims' lawyer cited for malpractice in $3.2
million judgment for Brooklyn man NEW YORK (AP) - A lawyer who
took a central role in publicizing Holocaust
recovery cases has been ordered to pay a $3.2
million malpractice judgment to a Brooklyn man
whose personal-injury case he neglected. The award against Edward Fagan,
below, outlined in a story published
Wednesday [August 11, 2004] in the New
York Law Journal, was granted by state Supreme
Court Justice Shirley Kornreich in May,
court records show. The money is owed to Allen Tavel, 51, who
said Fagan neglected his case against Honda Motor
Corp. and the manufacturer of a seat belt that
allegedly failed during a 1994 accident, leaving
him permanently disabled. Fagan has staged numerous news conferences about
cases seeking billions of dollars in damages as a
result of the Holocaust, apartheid
in South Africa and slavery in America. One
case against Swiss banks and German corporations
culminated in a settlement worth more than $6
billion. Fagan
began work on those cases about a year after taking
Tavel's case. A message left for Fagan Wednesday
was not immediately returned. The judge said Tavel had proven his malpractice
case, including that Fagan had sued the wrong
parties, had failed to oppose motions by other
lawyers in the case, had misled him about the
status of the case and had refused to return the
case file to him. The judge awarded Tavel $1.16 million for
economic loss, $1 million for past pain and
suffering and $1 million for future pain and
suffering. She said the former dental technician
and drummer will remain disfigured, debilitated and
