O.24, r.8 or under the inherent jurisdiction of the Court to address the defects set out in the Annex; and (b) the amended list be verified by affidavit; and (c) the costs of this application and the costs of preparing the amended list be paid by the Plaintiff in any event In the alternative for an order that 3(a) pursuant to R.S.C. 0.24. r.3 and/or r.7 the Plaintiff:- (i) serve a further and better List of documents verified by affidavit and/or; (ii) gives specific discovery verified by affidavit; in each case addressing the defects set out in Parts 2 and 3 of the Annex; and   (b) the affidavit also addresses the defects set out in part 5 of the Annex; and   (c) the costs of this application be paid by the Plaintiff in any event.   Dated the 13th day of May 1998.
