Thursday, June 10, 1999 David Irving's London staff e-mail that Mishcon have responded regarding the relevance of Document 126, the advertising rates for "Carnival"- and the request for a copy. The Mishcon letter states: "As you know, one of the issues in this case is whether you are a political extremist. The views expressed in the Carnival Times editorial that you wrote have been characterised as extreme. It is an early example of public expression of your political views and clearly relevant." | |||||
Mr Irving replies: Your letter stating: "As you know, one of the issues in this case is whether you are a political extremist. The views expressed in the Carnival Times editorial that you wrote have been characterised as extreme. It is an early example of public expression of your political views and clearly relevant." has been forwarded to me here. It is forty years (and one month) since I last looked at this satirical university magazine, Carnival Times, and I am dubious that the court will agree with you that it is relevant to the issues pleaded. We have in our files one issue in a very fragile condition. Your firm have not shown much respect for treating original documents carefully. We will undertake to provide to your clients a clear photocopy of the entire magazine, and to have the original in court. I should add that not all the articles were written by myself, though an editor of course is expected to carry the can. 2. May I remind you that we are awaiting the open letter that you were invited to write by Master Trench, listing those pertinent documents in which you intend to claim Schedule 1, Part 2 privilege of a nature similar to the videos? Master Trench stated: "How can a litigant trust the assertion of privilege under Order 25, rule 5 (2)" if he does not know what those documents are? I shall not let this matter rest. 3. A journalist Mr Don Guttenplan of Hampstead has contacted me, writing a feature on the action for the New York Times. I have provided him with certain information, so far as legally possible, and if you wish to answer his questions I shall raise no objection. David Irving (now writing at Key West, Florida, USA). para 3 copied to Mr Guttenplan. whole letter copied to Duke Street for information |
