David Irving v. Penguin Books Ltd & Anr

Thank you for your letter of 2nd December, with enclosures, which I will consider carefully.

Further to my letter of 29th November, I have now prepared and enclose:-

  1. Text to be included in Form N244;
  2. A minute of order (in triplicate);
  3. The skeleton argument (in triplicate);
  4. Copies of David's sixth affidavit and the exhibit thereto (in triplicate). [not posted]

I should be grateful to have a word with you about how we proceed from here. In particular, I should be interested to discuss whether we need wait for the revised transcript to come back from Smith Bernal before issuing the application, or whether (given the inevitable delay) we can safely issue now, and await receipt of the transcript in due course.

Perhaps you might also consider whether it would be appropriate to issue the application notice with a time estimate of thirty minutes in the first instance, on the basis that the first hearing will be effective for directions only. I suspect that Gray J. will wish to give directions (especially as to the filing of evidence in answer and evidence in reply) and to fix a date convenient to all counsel.
