Irving has sent this warning to Granta's chief
editor, Friday, March 16, 2001 :
As you know, I have had no qualms whatever about
your production of the Don Guttenplan
book on my lawsuit against Deborah
Lipstadt. This letter puts your
firm on notice that I have read the US edition
of the other book, by Prof. Evans,
currently titled Lying about Hitler, and
that I consider that book, from the title
onwards, to be actionable in very many respects.
On counsel's advice, notwithstanding that the
book is published in the USA, I may well shortly
issue proceedings against Evans (as I am
entitled, as both parties are domiciled in the
jurisdiction of the British courts). Should the
identical book appear in a UK edition, I would
of course be obliged to act against that
publisher instead, and the court would expect me
to. I emphasise that I am
not familiar with the manuscript currently on
offer to your firm. It has been rejected by Wm
Heinemann, very properly, as they correctly
anticipated that it would lead to unwanted
litigation. This opens the door to an action for
punitive damages against any other publisher
foolish enough to take the risk of producing
it. I have no objection
whatever to the publication of fair comment and
proper reporting, but [...] any
publisher who prints and publishes
[Evans'] book exposes himself to the
risk of being sued in defamation. I have yet to see the
English version of his book. You should be in no
doubt however that I will take action if I have
to, and that I shall reserve all my rights in
this
respect.
